Copyright & Illegal Content Notices

Effective Date Version 1.0.0

What changed in this version: this is the first version of this page.

Yomimaru is operated by Redmoon Systems OÜ, a private limited company (osaühing) registered in Estonia under registry code 17506382, with its registered address at Ruunaoja tn 3, Lasnamäe linnaosa, Tallinn, Harju maakond 11415, Estonia ("Redmoon", "we", "us", or "our"). Yomimaru also goes by the name of its website, yomimaru.app.

Learners can import their own Anki decks into Yomimaru. We store what they import (words, notes, pictures and recordings) privately for each learner. We do not publish it, and no other learner can see it. This page explains how to tell us about content stored in Yomimaru that you believe infringes your copyright or is illegal, and what we do when you do. It is how we meet our obligations under the EU Digital Services Act (Regulation (EU) 2022/2065, the "DSA") and the US Digital Millennium Copyright Act (17 U.S.C. § 512, the "DMCA").

1. Contact Points

One address handles every notice, counter-notice and question about content: [email protected]. A person reads every message sent there.

You can also reach us through the form at yomimaru.app/contact: choose the subject "Copyright or illegal content notice". The form takes messages of up to 4,000 characters and no attachments, so for a longer notice, or one that comes with a copy of a file, use email.

1.1. For authorities (DSA Article 11)

Our single point of contact for the authorities of the EU Member States, the European Commission and the European Board for Digital Services is [email protected]. You may write to us in English or Estonian.

Eesti keeles. Redmoon Systems OÜ (registrikood 17506382) ühtne kontaktpunkt liikmesriikide ametiasutustele, Euroopa Komisjonile ja digiteenuste nõukogule digiteenuste määruse (EL) 2022/2065 artikli 11 alusel on e-posti aadress [email protected]. Meiega võib suhelda eesti ja inglise keeles.

1.2. For users (DSA Article 12)

Our single point of contact for learners and anyone else who uses Yomimaru is also [email protected], or the form at yomimaru.app/contact. A person reads and answers every message. You may write to us in English.

2.1. Our designated agent

Send copyright notices and counter-notices under the DMCA to our designated agent:

  • Agent: Copyright Agent, Redmoon Systems OÜ
  • Address: Ruunaoja tn 3, Tallinn 11415, Estonia
  • Phone: +81 70 8538 2026
  • Email: [email protected]

Our agent is registered in the US Copyright Office's DMCA Designated Agent Directory under number DMCA-1083770.

2.2. What a notice must contain

Under 17 U.S.C. § 512(c)(3), a notice of claimed infringement must be in writing and include:

  1. a physical or electronic signature of the copyright owner or of a person authorised to act for them;
  2. identification of the copyrighted work you claim is infringed (or, for several works, a representative list);
  3. identification of the material you claim is infringing, with enough information for us to find it;
  4. your name, postal address, telephone number and email address;
  5. a statement that you believe in good faith that the use of the material is not authorised by the copyright owner, its agent or the law;
  6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner's behalf.

Imported content is private and has no public web address, so tell us everything you know that helps us find it: the email address of the Yomimaru account that holds it, if you know it, the name of the deck, and the picture, recording or text concerned. If you have a copy of the file, attach it: once we know the account, it lets us find the exact file, even under another name.

Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages.

2.3. What we do with a notice

A person reviews the notice. If it is incomplete, we may ask you for what is missing. If it is valid, we promptly remove the material or disable access to it, and tell the learner concerned, with a copy of the notice.

2.4. Counter-notices

If you are the learner and you believe the material was removed by mistake or because it was misidentified, you may send our designated agent a counter-notice. Under 17 U.S.C. § 512(g)(3), it must be in writing and include:

  1. your physical or electronic signature;
  2. identification of the material that was removed or to which access was disabled, and where it was before;
  3. a statement, under penalty of perjury, that you believe in good faith that the material was removed or disabled as a result of a mistake or misidentification;
  4. your name, address and telephone number, and a statement that you consent to the jurisdiction of the US Federal District Court for the judicial district where your address is (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice or that person's agent.

When we receive a valid counter-notice, we send a copy to the person who sent the original notice and tell them that the material can come back in 10 business days. Unless our designated agent first receives notice that they have filed a court action seeking to restrain you from the infringing activity, we restore the material, or let you upload it again, between 10 and 14 business days after we received the counter-notice. Our removal deletes the file, so restoring it usually means you import the deck again, which uploads any file it is missing.

2.5. Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe copyright. We keep a record of the copyright notices we act on, by account, for this purpose.

3. Notices of Illegal Content (DSA Article 16)

Anyone can tell us about content stored in Yomimaru that they believe is illegal under EU law or the law of an EU Member State, including copyright infringement. Send your notice to [email protected] or through the form at yomimaru.app/contact. It should contain:

  1. a sufficiently substantiated explanation of why you consider the content illegal;
  2. a clear indication of where the content is. Imported content has no public web address, so give us what you know: the email address of the Yomimaru account that holds it, the deck, and the picture, recording or text concerned, with a copy of the file if you have one;
  3. your name and email address. You may leave them out if the content concerns one of the child sexual abuse offences in Articles 3 to 7 of Directive 2011/93/EU;
  4. a statement that you believe in good faith that the information and allegations in the notice are accurate and complete.

4. What Happens Next

  1. Confirmation. If you gave us an email address, we confirm by email that we received your notice, without undue delay.
  2. Review. A person reviews every notice. We use no automated tools to find content, assess a notice or decide what to do about it. We do not scan or monitor what learners import; we act on the notices we receive.
  3. Decision. We decide in a timely, diligent, non-arbitrary and objective manner, and tell you what we decided and how you can challenge it.
  4. Action. If the content is illegal, or breaches our Terms of Service, we may delete it from the learner's account (a single picture, recording or note, or a whole deck) and, in serious or repeated cases, suspend or terminate the account. A deck card whose picture or recording we removed still shows, without it.
  5. Statement of reasons. We email the learner concerned a statement of reasons (DSA Article 17). It says what we removed or restricted and for how long, the facts we relied on, whether we acted on a notice (and who sent it, only where that is strictly necessary), that no automated means were used, the law or the clause of our Terms we relied on, and how to challenge the decision. The learner can reply to that email to ask us to look again, and can take the matter to court.
  6. Threats to life or safety. If a notice gives us reason to suspect a criminal offence involving a threat to someone's life or safety, we inform the law enforcement or judicial authorities concerned (DSA Article 18).
